VCI Implementation Guide on Compliance with Environmental Claims

The VCI has compiled a paper outlining what companies need to consider when making environmental claims starting September 27.
 
The implementation guide from the Verband Chemische Industrie (German Chemical Industry Association, VCI) regarding the EU Empowering Consumers Directive (EmpCo) is intended to provide companies in the industry with a concise overview of the new legal framework for green claims. In a press release, the association points out that with the implementation of the EmpCo starting September 27, 2026—which in Germany is partially regulated by the Unfair Competition Act (UWG)—significantly stricter rules will apply to environmental and sustainability claims. By that date, companies must review existing green claims (environmental claims), sustainability labels, and climate neutrality pledges. According to the VCI, new disclosure requirements regarding warranties and guarantees must also be observed. The association’s implementation guide is to provide a concise overview of the most important changes and answers practical questions regarding the third amendment to the UWG. According to the VCI, the paper includes not only a comprehensive checklist for reviewing environmental claims but also links to the relevant legal basis and interpretive guidance.
